Overview:<\/strong> This paper deals with civil wrongs (torts), remedies, and the relatively new facet of consumer rights. It covers both traditional tort law principles and the Consumer Protection Act.<\/p>\n\n\n\n

Objectives:<\/strong> To understand what constitutes a tort, including the elements of liability (negligence, intentional torts), defenses, and remedies (damages, injunction). Students learn about specific torts such as nuisance, defamation, and negligence. The course also introduces the Consumer Protection Act, 1986 (now Consumer Protection Act, 2019) as a remedial statute for consumer rights.<\/p>\n\n\n\n

Learning Outcomes:<\/strong> Students should be able to identify and analyze situations for tortious liability<\/em>, apply the standard of care (reasonable person) in negligence, and differentiate tort from contract and crime. They will know the defenses (consent, necessity, etc.) and special liability rules (strict liability, vicarious liability). For consumer law, students will understand consumer rights (defective product, deficiency of service) and the redressal agencies<\/em>.<\/p>\n\n\n\n

  1. Introduction:<\/strong>\u00a0Nature and scope of tort law; purposes of tort (deterrence, compensation). Distinctions between tort, crime, contract.<\/li>\n\n\n\n
  2. Kinds of Torts:<\/strong>\u00a0Intentional (battery, assault, false imprisonment) vs. unintentional (negligence).<\/li>\n\n\n\n
  3. Defenses:<\/strong>\u00a0Volenti non fit injuria (consent), necessity, illegality, contributory negligence, plaintiff\u2019s own wrong.<\/li>\n\n\n\n
  4. Vicarious Liability:<\/strong>\u00a0Employer\u2019s liability for employee\u2019s acts, masters and servants.<\/li>\n\n\n\n
  5. Strict Liability:<\/strong>\u00a0Rule in\u00a0Rylands v. Fletcher<\/em>,\u00a0M.C. Mehta v. Union of India<\/em>\u00a0(hazardous activities, absolute liability).<\/li>\n\n\n\n
  6. Product Liability:<\/strong>\u00a0Modern developments (e.g. defective goods) \u2013 introduced under consumer law.<\/li>\n\n\n\n
  7. Torts Special:<\/strong>\u00a0Nuisance (public\/private), negligence (duty of care, breach, causation \u2013\u00a0Donoghue v. Stevenson<\/em>,\u00a0Regina v. Brins<\/em>\u00a0cited for standard), defamation (libel & slander), privacy tort.<\/li>\n\n\n\n
  8. Remedies:<\/strong>\u00a0Damages (remoteness \u2013\u00a0Hadley v. Baxendale<\/em>\u00a0for contract vs. tort), injunctions (restraining orders).<\/li>\n\n\n\n
  9. Consumer Protection:<\/strong>\u00a0Concepts of consumer, service, and goods; rights of consumers; structure of Consumer Courts (District, State, National Commissions). Briefly mention CPC processes in consumer cases.<\/li>\n<\/ol>\n\n\n\n
