Getting to Learn more about Constitutional Law II<\/p>\n\n\n\n<p><strong>Objectives:<\/strong>&nbsp;Study the distribution of powers, functioning of Parliament and Executive, emergency provisions, and constitutional amendment process.<\/p>\n\n\n\n<p><strong>Outcomes:<\/strong>\u00a0Students will know how law-making works (Art. 107-111), the President\u2019s role (Art. 52-78), Centre-State relations (Union vs State lists, Art. 246), and emergency powers (Part XVIII). They will analyze a constitutional amendment case or a centre-state dispute.<\/p>\n\n\n\n<p><strong>Syllabus (Topics) \u2013 CCSU<\/strong>:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Parliament:<\/strong>\u00a0Structure (Lok Sabha, Rajya Sabha), legislative process (Art. 107: Money Bills, ordinary bills), parliamentary privileges.<\/li>\n\n\n\n<li><strong>Executive \u2013 President:<\/strong>\u00a0Election, powers (assents, ordinances, emergency proclamations).<\/li>\n\n\n\n<li><strong>Prime Minister\/Cabinet:<\/strong>\u00a0Role of PM; \u201creal head\u201d doctrine (compare President vs PM in practice).<\/li>\n\n\n\n<li><strong>Legislative Distribution:<\/strong>\u00a0Union, State, Concurrent lists (Seventh Schedule). Doctrine of\u00a0<em>Pith and Substance<\/em>\u00a0and\u00a0<em>Colourable Legislation<\/em>\u00a0in case of overlapping laws. Territorial nexus (ratione loci) concept for extra-territorial legislation.<\/li>\n\n\n\n<li><strong>Emergency Provisions:<\/strong>\u00a0Art. 352 (National Emergency), Art. 356 (President\u2019s Rule in states), Art. 360 (Financial Emergency); conditions, effects, judicial review (<em>S.R. Bommai<\/em>\u00a0on 356).<\/li>\n\n\n\n<li><strong>Judiciary:<\/strong>\u00a0Composition of Supreme Court (Art. 124), original vs appellate jurisdiction, advisory jurisdiction (Art. 143).
