Overview:<\/strong> Principles and institutions of international law.<\/p>\n\n\n\n

Objectives:<\/strong> To introduce students to the nature, sources, and subjects of international law, state sovereignty, and the law governing inter-state relations (peace, war, treaties, jurisdiction).<\/p>\n\n\n\n

Outcomes:<\/strong> Students will be able to define international law, list its sources (custom, treaties, general principles), and analyze specific domains like laws of war, territorial sovereignty, and dispute resolution<\/em>. For example, they should explain how a treaty is formed and enforced (e.g. Vienna Convention), and discuss the concept of \u2018state\u2019 and recognition of governments.<\/p>\n\n\n\n

Syllabus \u2013 CCSU<\/strong>:<\/p>\n\n\n\n

  1. Theoretical Foundation:<\/strong>\u00a0Definitions of international law, its scope vs. national law.<\/li>\n\n\n\n
  2. Sources:<\/strong>\u00a0(a)\u00a0Custom<\/strong>\u00a0(consistent state practice + opinio juris); (b)\u00a0International conventions\/treaties<\/strong>\u00a0(e.g. UN Charter, ICCPR); (c)\u00a0General principles<\/strong>\u00a0(like equity); (d)\u00a0Decisions and writings<\/strong>\u00a0(ICJ, works of jurists).<\/li>\n\n\n\n
  3. Relation with Municipal Law:<\/strong>\u00a0Monism vs. dualism theories; how India incorporates international law (Article 253, treaty overrides). Compare with British practice (doctrine of transformation).<\/li>\n\n\n\n
  4. State Characteristics:<\/strong>\u00a0Concept of state, sovereignty (Westphalian); territory (land, territorial sea, airspace, continental shelf, exclusive economic zones). Acquisition\/loss of territory. Recognition of states and governments.<\/li>\n\n\n\n
  5. Diplomacy & Treaty Law:<\/strong>\u00a0(Covered in course but not explicitly in syllabus, but taught).<\/li>\n\n\n\n
  6. Use of Force & War:<\/strong>\u00a0Laws of war (jus ad bellum vs jus in bello) \u2013 war crimes (e.g. crimes against humanity), neutrality, protection of civilians, genocide (refer to Genocide Convention, mention Nuremberg principles).<\/li>\n\n\n\n
  7. Sea Law:<\/strong>\u00a0Territorial waters (12 n.m.), Contiguous zone (24 n.m.), EEZ (200 n.m.), continental shelf regimes.<\/li>\n\n\n\n
  8. Dispute Resolution:<\/strong>\u00a0Pacific (negotiation, arbitration, ICJ) vs. Coercive (force illegal per UN Charter).<\/li>\n\n\n\n
  9. International Organizations:<\/strong>\u00a0(At least mention UN, ICJ, maybe briefly human rights organs).<\/li>\n<\/ol>\n\n\n\n
