Overview:<\/strong> Transfer of Property Act, 1882 \u2013 study of immovable property rights (sale, mortgage, lease, etc.) and easements.<\/p>\n\n\n\n

Objectives:<\/strong> To understand how ownership and possession of property are regulated, and the creation\/transfer of interests in property.<\/p>\n\n\n\n

Outcomes:<\/strong> Students will explain how a person can transfer property through sale, mortgage, lease, exchange, gift, and how easements are acquired.<\/em> They will differentiate types of mortgages, remedies for breach of sale contract (under SR Act), and the notion of actionable claims.<\/p>\n\n\n\n

  1. Transfer of Property (Sec. 5-37):<\/strong>\u00a0Definitions (immovable property, transfer), operation (by act of parties).<\/li>\n\n\n\n
  2. Immovable Property (38-53A):<\/strong>\u00a0How general transfer provisions apply specifically.<\/li>\n\n\n\n
  3. Sale (54-57):<\/strong>\u00a0Contract of sale (goods) \u2013 but here 54-57 deals with immovable property sale.<\/li>\n\n\n\n
  4. Mortgage (58-104):<\/strong>\u00a0Types (simple, equitable, conditional sale mortgage, etc.), rights of mortgagor\/mortgagee, foreclosure, redemption.<\/li>\n\n\n\n
  5. Lease (105-117):<\/strong>\u00a0Definitions (lease, lease amount), rights\/duties of lessor\/lessee, determination.<\/li>\n\n\n\n
  6. Exchange (118-121):<\/strong>\u00a0How exchange differs from sale.<\/li>\n\n\n\n
  7. Gift (122-129):<\/strong>\u00a0Essentials (donor, donee, delivery), irrevocability after acceptance.<\/li>\n\n\n\n
  8. Actionable Claims (130-137):<\/strong>\u00a0Meaning (claim for debt\/benefit not secured by mortgage etc.), transfer by assignment.<\/li>\n\n\n\n
  9. Indian Easements Act (1882):<\/strong>\u00a0How easements (right to use neighboring property for light, passage, support, etc.) are acquired (prescription) and extinguished.<\/li>\n<\/ol>\n\n\n\n
